of Participation in SJS S.A. Automotive Events

We are here to provide you with automotive excitement in the safest possible conditions. However, motorsports involve inherent risks. Your safety and the safety of other participants is our priority, but it largely depends on how basic safety rules are followed.
Before heading out onto the track, please read the regulations below. They outline the requirements for participants, rules of conduct on the track, and liability. The appendix also describes the rules for processing your personal data.
The rules described in this document apply to all individuals participating in automotive events organized by SJS S.A., including advanced driving technique training sessions, sports car drives, and corporate events.
Your participation in the event constitutes full acceptance of these terms.
1. Organizer
1.1 Details: The organizer of the events is SJS S.A. with its registered office in Krakow (ul. Żeleńskiego 103, 31-353 Kraków), KRS: 0000333645, NIP: 9451931797, share capital: PLN 400,000.00 (hereinafter: "Organizer" or "we")

2. Participant Requirements
2.1 Instructor briefing. Before entering the track, every Participant is required to take part in a briefing conducted by our instructors. During the briefing, we will provide you with detailed instructions regarding the event you are participating in. These instructions supplement the general safety rules described in this document. You are obligated to comply with them throughout the duration of the event.
2.2 Health status, sobriety, and license: A prerequisite for being allowed to drive is holding a valid driver's license of the appropriate category. Your health status and psychophysical condition must allow for the safe operation of the vehicle. In particular, driving under the influence of alcohol, narcotics, or medication that impairs concentration is strictly prohibited.
2.3 Testing: The Organizer reserves the right to verify the condition of Participants regarding sobriety or being under the influence of other intoxicating substances. Refusal to undergo testing may result in exclusion from the event without the right to a refund.
2.4 Attire: We recommend comfortable clothing and footwear in which the participant feels comfortable while driving the vehicle. In open-top vehicles, wearing a helmet is mandatory. The Organizer provides a helmet in its vehicles. For participants' own vehicles, they must provide their own helmet or rent one during the event (the number of helmets is limited).
3. Rules of Conduct of the Track
3.1 Instructor's orders: You have an absolute obligation to comply with the orders, instructions, and commands issued by the instructors and the Organizer's staff.
3.2 Signals: It is mandatory to strictly adhere to light or flag signals, if present at the event venue.
3.3 Preparation for driving: The driver and passenger must have their seatbelts fastened. We always drive with low-beam headlights turned on. Mobile phones and the car radio must be turned off.
3.4 Safety systems: The electronic stability program (ESP) must remain active at all times – turning it off is strictly forbidden.
3.5 Speed and control: Move the vehicle only upon the instructor's command. Always control your speed and adapt it to your skills, weather conditions, and surface type. The speed must not exceed that set by the instructor or indicated by road signs when driving on public roads.
3.6 Traffic regulations: When driving on public roads, the provisions of the Road Traffic Law Act (pl. prawo o ruchu drogowym) and the Act on Vehicle Drivers (pl. ustawa o kierujących pojazdami) apply. Additional internal regulations established by the facility owner may apply at the venue where the event takes place. The Participant is required to review and comply with them.
3.7 Speed restriction zones: On access roads, the maximum speed is 40 km/h, maintaining a safe distance. A 20 km/h limit applies in the PIT-STOP area. Blue posts indicate a speed restriction zone and slow driving.
3.8 Driving in a convoy: We move in a convoy, maintaining the originally established order of cars and maximum concentration. Anticipate situations on the track and maintain a safe distance from the preceding vehicle.
3.9 Overtaking: Overtaking or passing each other is prohibited. Overtaking is permitted exclusively upon the explicit command of the instructor.
3.10 Track traffic: We move on the track clockwise (driving against traffic is prohibited), unless otherwise instructed by the instructor.
3.11 Driving outside the module: Participants are not allowed to practice outside the training module currently conducted by the instructor.
3.12 Breakdowns: In the event of technical problems, stop the vehicle, turn on the hazard lights, and wait for the instructor. If you notice a fluid leak, immediately pull off the asphalt track surface. Any damage to the vehicle must be reported immediately to the instructor or the Organizer's staff.
3.13 Discontinuation: The instructor has the right to refuse your participation in the event or terminate your participation, and in special circumstances, demand that you leave the event venue, if:
3.13.1 You do not follow the instructor's instructions;
3.13.2 You violate applicable safety rules or venue regulations;
3.13.3 Your behavior is inappropriate, disturbs other event participants, or poses a threat to the safety of yourself, third parties, or property;
3.13.4 You are under the influence of alcohol, other intoxicating substances, or medications that impair concentration.
4. Rules for Using Own Vehicles. If you participate in the event with your own vehicle, the following additional regulations apply:
4.1 Authorized use: You must be authorized to use the vehicle for the purpose of participating in the event
4.2 Technical roadworthiness: The vehicle must be suitable for the type of event, fully roadworthy, and have a valid technical inspection and third-party liability (OC) insurance. We also recommend having comprehensive (AC) and personal accident (NNW) insurance.
4.3 Loose items: Before driving, we recommend unloading luggage and fire extinguishers, as well as dismantling CB radio antennas.
5. Participant’s Liability and Track Incidents
5.1 Liability for damages: As a participant, you assume full liability for damages resulting from your driving caused to yourself and your property, the Organizer, the facility owner, and third parties (e.g., arising from damage to Organizer’s vehicle you used, devastation of track infrastructure, or personal injury), both when driving your own vehicle and one the Organizer gave you for your participation in the event.
5.2 Own vehicle: If you participate in the event with your own vehicle, you do so at your own risk and responsibility. The Organizer is not liable for any breakdowns, damage, or loss of your vehicle, nor for any resulting inability to participate or continue participating in the event. If you cause damage with this vehicle (e.g., to yourself, the Organizer, the facility owner, or another participant), you bear full liability. In the event of a road traffic incident involving participants' own vehicles, the parties involved shall resolve all disputes independently, without the involvement of the Organizer.
5.3 Incidents caused by the fault of a participant: In the event of an incident caused by the fault of a participant (e.g., damage to the Organizer's vehicle):
5.3.1 The Organizer may refuse the participant further participation in the event;
5.3.2 The Organizer independently makes decisions regarding the continuation of the event and its further scope. In particular, the event may continue without the damaged vehicle or the module/automotive attraction where the damage occurred. As a rule, a replacement vehicle will not be provided in place of the damaged one.
6. Complaints
6.1 Any complaints regarding the execution of the event can be submitted during the event directly to the Organizer's staff, as well as after the event using the Organizer's contact details provided in section 1.1.
6.2 The Organizer will review the complaint without undue delay, no later than 14 days from the date of its receipt.
6.3 The complaint should include the first and last name, a description of the incident forming the basis of the complaint, and the Participant's demand.
7. Marketing
7.1 The Participant may not place any promotional or advertising materials at the facility or on vehicles belonging to the Organizer without obtaining the prior consent of the Organizer.
7.2 Filming, taking photographs, and their subsequent publication require the prior consent of the Organizer in each instance.
8. Personal Data Protection
8.1 The Organizer is the controller of the Participant's personal data. Detailed information regarding the processing of Participants' personal data can be found in Appendix No. 1.
9. Final Provisions
9.1 For matters not regulated in this document or in additional regulations of the facility where the event takes place, the provisions of the Civil Code shall apply. The Organizer may introduce changes to this document.
9.2 The Participant is bound by the version of the document made available to them directly prior to their participation in the event.
Appendix No. 1
GDPR Information Clause - Rules for the Processing of Personal Data
We care about protecting your privacy and make every effort to ensure that the processing of personal data is carried out in accordance with applicable legal regulations, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 ("GDPR").
Below we present detailed information regarding the processing of personal data in connection with your participation in the automotive event.
1. Data Controller
1.1 The personal data controller is the Organizer, i.e., SJS S.A. with its registered office in Krakow (ul. Żeleńskiego 103, 31-353 Kraków), KRS: 0000333645, NIP: 9451931797, share capital: PLN 400,000.00.

1.3 We have appointed a Data Protection Officer, who can be contacted via email at iod@dmt.com.pl.
2. Categories of Processed Data
2.1 In connection with your participation in the event, we will process your personal data to the extent necessary to achieve the goals of the event and ensure safety. Depending on the event, data categories include all or some of the following:
2.1.1 Identification data: first name, last name, driver's license number, and data necessary to verify the driver's entitlements;
2.1.2 Contact data: phone number, email address;
2.1.3 Image and voice (in the case of recording the drive and/or capturing the event for promotional purposes);
2.1.4 Health data: sobriety information (solely for the purpose of ensuring safety and admission to participate in the drive).
3. Purposes and Legal Bases
3.1 Performance of services related to participation in the event, verification of identity and driving entitlements, collecting statements confirming review of the event’ terms and conditions (Art. 6(1)(b) of the GDPR - necessity for the performance of a contract).
3.2 In the case of participating in the event on behalf of a third party (e.g., an employer), we process your data in order to admit you to the event, verify your identity and driving entitlements, and collect statements confirming review of the rules of participation in the event (Art. 6(1)(f) of the GDPR - legitimate interest consisting in enabling your participation in the event and ensuring its safety).
3.3 Fulfillment of legal obligations binding on the controller, such as tax and accounting obligations related to the proper financial settlement of the event (Art. 6(1)(c) of the GDPR).
3.4 Consideration and handling of submitted complaints (Art. 6(1)(c) of the GDPR - obligation resulting from legal provisions, and Art. 6(1)(f) of the GDPR - our legitimate interest consisting in the necessity to defend our position).
3.5 Establishment, exercise, or defense against claims related to the performance of the contract or provided services (Art. 6(1)(f) of the GDPR - legitimate interest consisting in protecting our rights and pursuing claims).
3.6 Recording the drive using an image and/or sound recording device to ensure the safety of participants and instructors, verify compliance with safety rules, and secure potential evidence in the event of an incident (Art. 6(1)(f) of the GDPR - legitimate interest consisting in ensuring the safety of persons and property and pursuing or defending against claims).
3.7 Sobriety testing of participants to ensure safety during the event and potentially remove participants who could pose a threat to persons or property from the event (Art. 6(1)(f) of the GDPR - legitimate interest consisting in protecting life, health, and property, and Art. 9(2)(a) of the GDPR - the participant's consent to the processing of health-related data).
3.8 Use of image for event documentation, promotional, and marketing purposes, including through the publication of photos and recordings from the event on our websites and social media channels (Art. 6(1)(a) of the GDPR - participant's consent, or Art. 6(1)(f) of the GDPR - legitimate interest, depending on the subject of the photo or recording).
4. Photo-Video Documentation, Drive Recording, and Venue Monitoring
4.1 Photographic and video documentation may be taken during automotive events. It may capture the image of participants, even if the photos are taken in an open space. The resulting materials may subsequently be published on our websites and on social media platforms (e.g., Facebook, Instagram, LinkedIn, YouTube) for promotional and marketing purposes.
4.2 The Participant has the right at any time to object to the processing of personal data, including their image, pursuant to Art. 21 of the GDPR, on grounds relating to their particular situation.
4.3 Part of our car fleet is equipped with recorders (cameras) that record the view in front of the vehicle, the image inside the cabin, and/or sound. These recordings are saved on the device's memory card and automatically overwritten (loop mode) by another recording once the card's capacity is exhausted. The recordings may be copied to another medium to be secured as evidence if an incident involving the vehicle occurs or in other justified cases (e.g., submitting a complaint or claims related to the organized event).
4.4 Facilities where events are held may be covered by a video monitoring system managed directly by the owners or managers of those facilities. By entering the event area, the participant accepts their presence in the monitored zone. We are not the data controller for this monitoring. The purpose, scope, and duration of processing these recordings are determined by the privacy policies of the respective facilities, and any questions in this regard should be directed directly to the facility managers.
5. Recipients of Personal Data
5.1 Personal data of participants may be transferred to the following categories of recipients:
5.1.1 IT and hosting service providers;
5.1.2 Operational subcontractors supporting the organization of events (e.g., external instructors, event security companies, external photographers, and camera operators);
5.1.3 Managers of the facilities where the event takes place;
5.1.4 Administrative and professional services (e.g., accounting and bookkeeping offices, law firms, marketing and advertising agencies);
5.1.5 Financial institutions, if they require reporting of incidents (e.g., the company leasing the vehicle);
5.1.6 Public authorities and institutions authorized to obtain data based on legal regulations (e.g., tax authorities, Police, Fire Department, Emergency Medical Services).
5.2 The transfer of data takes place exclusively on the basis and within the limits of applicable legal regulations and, where required by regulations, on the basis of appropriate contracts with third parties.
6. Data Transfer to Third Countries
6.1 As a rule, your personal data is not transferred outside the European Economic Area (EEA). However, we use external service providers (e.g., IT services) that operate outside the EEA (e.g., in the USA) and, depending on the given service, may process data in their country. In particular, in the case of publishing event materials on our website and social media channels, your personal data (image) may be transferred to third countries, including the USA, due to the location of the servers and headquarters of these service providers.
6.2 In any case of transferring your data outside the EEA, we will do so in compliance with applicable laws. In particular, for the purpose of each data transfer, we will ensure the implementation of an appropriate mechanism enabling such a transfer (e.g., transferring data to a country covered by an adequacy decision of the European Commission regarding the level of data protection, or under an agreement incorporating Standard Contractual Clauses).
7. Data Retention Period
7.1 Personal data will be stored:
7.1.1in relation to the performance of the contract and ensuring event safety - for the period necessary to perform the contract, and subsequently until the expiry of the limitation period for potential claims. Data visible on an identity document or driver's license is processed only for the time necessary to inspect the content of the document;
7.1.2 in relation to reviewing complaints - until the expiry of the limitation period for potential claims;
7.1.3 in relation to compliance with legal obligations - for the period required by legal regulations;
7.1.4 in relation to the promotion and marketing - until an objection to data processing is raised or consent is withdrawn;
7.1.5 in relation to the use of the image - until consent is withdrawn, if the use of the image requires the participant's consent;
7.1.6 in relation to recording drives using image and/or sound recording devices - until the recording is overwritten, and in the case of an incident or submission of a complaint or claims, until the expiry of the limitation period for potential claims.
8. Data Subject Rights
8.1 You have the following rights:
8.1.1 The right to access personal data and receive a copy thereof;
8.1.2 The right to rectify (correct) personal data;
8.1.3 The right to erase data in cases specified in the GDPR;
8.1.4 The right to restrict data processing;
8.1.5 The right to object to data processing based on the legitimate interest of the controller;
8.1.6 The right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal – to the extent that data is processed on the basis of consent;
8.1.7 The right to data portability;
8.1.8 The right to lodge a complaint with the President of the Personal Data Protection Office.

9. Additional Information
9.1 Providing personal data is voluntary, but necessary to the extent that it constitutes a condition for participating in the event. Failure to provide data will prevent us from safely providing services to you.
9.2 Your data is not subject to automated decision-making, including profiling.
9.3 We apply appropriate technical and organizational measures ensuring the protection of processed personal data, including data encryption and IT infrastructure security.
9.4 Access to personal data is granted exclusively to authorized individuals obligated to maintain confidentiality.
9.5 We reserve the right to introduce changes to this information clause.
